The devil is in the details of this sentence:
"Using information released by TREB in early July, he published a visualization of trends in Toronto's housing market."

Did he:
1 - Scrape pages from TREB all which indicated copyright
or
2 - TREB published a dataset with an Open Data license and he used this for his web site.

If #1, then he should not be surprised by this outcome.

Yes, I read what Teresa Scassa said. If this were true, we wouldn't need Open Data licenses...

This might be true (I am not a lawyer), but if you need a court to decide it,  it doesn't really matter to ordinary folk. You can be silenced by the deep legal costs of going to court (or avoiding that).

"Historic house prices can be found in the land registry system, while property taxes are a matter of public record and should be available through the City of Ottawa."

So if you take the property tax for a house you can use it to get back to the estimated house price.  It might not be the complete answer but it would a lot of pressure on someone.
