In The Fourth Paradigm: Data-Intensive Scientific Discovery edited by Tony Hey, Stewart Tansley & Kristin Tolle, (http://research.microsoft.com/en-us/collaboration/fourthparadigm/contents.aspx) includes a chapter dedicated to access to scientific data.

Science, has been and continues to be the big driver of access to data.  Science funding is often from the public purse, conducted in scholarly public institutions and as the argument goes, should be accessible for future scientists and to inform other scientific endeavours.

I do not know the geneology of access to public data discourses, but, I suspect it comes from scientists.  Contemporary discourse from law - Lessig, Geist and others are relatively new.  Librarians and archivists, have however, been discussing public access to information and data and for centuries.
