Amendment to the geoinformation legislation for Spatial Data in Germany

This is astonishing!  Spatial data, along with census type of
initiatives, are some of the most expensive datasets produced by
government.  To have this as part of legislation is fantastic.

Dear colleagues of GEO,

looking back to the ninth Plenary of GEO, I want to give further
information to the amendment to the geoinformation legislation for
Spatial Data in Germany:


In Germany, the idea of the GEO Data Sharing Principles of open and
free Geo (Spatial) Data has now been successfully implemented into a
new Federal legislation. On Friday, 16.11.2012, the amendment to the
geoinformation legislation came into force, that

on the Federal Level in general all Spatial Data and Metadata are to
be made available via spatial data services free of charge for
commercial and non-commercial use, the terms of use are well ordered
by a binding regulation.

At the Annex, I submit specific Power Point Slides. This PP was held
at the Meeting of the Data sharing Working Group (DSWG) in Foz do
Iguazu.

The most important paragraph of the amendment to the legislation is
stated as follows:

§11 (2) GeoZG:

·        Spatial data and metadata are to be made available via
spatial data services free of charge for commercial and non-commercial
use, unless otherwise provided for by a specific legislative provision
and provided that this does not contravene the contractual or legal
rights of a third party. (Please note, that this is not an official
translation. It is not validated by the legal service.)

That is really positive news. It helps to build momentum. Those organizations which are timid may now feel empowered to open their data more fully.
